Detailed Description of Goods and/or Services

KolleGin is an online store in the gift market and boutique gin industry.

Agreement of Sale

An agreement of sale between KolleGin and a customer is only valid once payment has been made and the company receives proof of payment. Up until this point, all goods remain the property of KolleGin.

Delivery Policy

Subject to availability and receipt of payment, orders will be processed and delivered within 2-5 working days.

Wholesale suppliers do not qualify for free shipping and will have the option to arrange their own shipping or request a quote from us for the shipping cost of their orders.

All orders are dispatched via the Post Office, courier service or international air mail.

You accept that in order for us to prove delivery of an order, we do not have to prove that you personally received the goods, but rather that any person at the delivery address signed for the delivery.

Return and Refunds Policy

The provision of goods and services by KolleGin is subject to availability. In cases of unavailability, KolleGin will contact you with options

An order can be cancelled if payment has not been made yet for the order by the customer. Once payment has been made by the customer for an order, the order can also be cancelled, but a cancellation fee will be payable by the customer in an amount equal to 20% of the total Tax Invoice amount. The customer will also be responsible for any return/shipping cost with regards to returning the products to KolleGin. Products must be returned in its original sealed packaging and without any damages or breakage.

If a product is damaged or broken when you receive it, you must inform KolleGin within one working day of receiving it. We will then make arrangements for a replacement product to be sent to you on our account or to refund you in full for the damaged or broken product. Upon receipt, we will inspect the items and if it is in its original sealed state, we will refund you the value of the products within 30 days thereof. If the products are opened or used by the customer, KolleGin will not be held responsible for issuing a refund.

If you receive the wrong product you must contact KolleGin within ten working days. We will check our system to see whether a miss pick has occurred. If there was a miss pick we will arrange to swap the ‘wrong’ product for the one actually ordered on our account.

Customer Privacy Policy

We respect your privacy and your personal information, thus, we take all reasonable measures to protect your personal information and to keep it confidential.

KolleGin shall take all reasonable steps to protect the personal information of Clients and for the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act, Act 2 of 2000 (“PAIA”) and the Protection of Personal Information Act 4 of 2013 (”POPI”).

The manner in which we collect your personal information will be by way of you contacting us telephonically, personally or electronically.

The personal information hereby provided by the customer will be collected, disclosed, used, processed and stored as is necessary to carry out lawful actions and functions for the conclusion or performance of the agreement entered into between us, and will only be done with your written consent where required, unless we are legally required to do divulge same or are obligated to do so for performance of a public law.

By agreeing to these terms and conditions you hereby provide us with your express written consent to use your personal information, share certain of your personal information, to analyse your personal information in order to compile a profile of you, and to send promotional material to you in the ordinary course of our business.
We will not sell, rent or provide your personal information to any unauthorised third parties without your consent. If at any stage, after you have given us consent, you no longer wish us to use or share your personal information with an affiliate party, you may at any stage withdraw your consent in writing.

Customer Details Separate from Card Details

Customer details will be stored by KolleGin separately from card details which are entered by the customer on the Virtual Card Services secure payment terminal. For more detail on Virtual Card Services visit the Virtual Card Services website.

Merchant outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. The transaction currency is South African Rand (ZAR).

Responsibility

KolleGin takes responsibility for all aspects relating to the transaction including sales of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
By law you are not permitted to sell alcohol without a valid liqour license.

The trade marks, logos and service marks (‘intellectual property’) displayed on our website are the registered and unregistered marks of KolleGin, our affiliates, our suppliers, our licensors and/or our and are protected by South African and international trade mark laws. Except in connection with placing an order for merchandise or as required by applicable law, you may not use, reproduce, duplicate, copy, sell, resell, access, modify or otherwise exploit our intellectual property or that of our suppliers without our or their prior written consent.

Complaints

We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise. Please inform us of any complaint in writing.

Product Liability

KolleGin shall not be held liable for any damages, injury or illness caused by the misuse of any product. It is the sole responsibility of the customer to read all product instructions carefully, to use the product strictly for the purpose it was designed for, and to ensure that the product is used in a safe and reasonable manner. KolleGin shall not be held responsible for any damages, injury or illness that occur due to an allergic reaction, or as the result of any other unforeseen occurrence.

Statutory rights

Nothing contained in these Terms and Conditions of Sale affects or will affect the statutory rights of the Customer or the Recipient in relation to the quality, fitness or description of the goods supplied.
